We are very pleased to announce that on the 5th of February 2020 ConsultANZ became a registered Labour Hire Provider in the state of Victoria.
What is a Labour Hire Provider?
A labour hire provider is a business that has an arrangement in place with one or more individuals to supply the individuals to perform work in and as part of a host’s business or undertaking and is obliged to pay the individual for the work performed for the host.
Under the LHL Act, all labour hire providers must be licensed.
How do I know if the arrangement is a labour-hire service?
Some factors that might suggest a worker is performing work in and as part of the host’s business include:
- the work is performed at the host’s premises
- the work is subject to the host’s direction
- the work is supervised or managed by the host or another labour-hire worker supervised or managed by the host
- the work is not a specialised service
- the work is a key function of the host’s business or undertaking
- the work is of a similar nature to work performed or previously performed by the host’s own employees.
The above list is not exhaustive and these and any other factors are not determinative on their own.
How to check if your Recruitment Agency is a licensed labour-hire provider?
Licensed providers can show they have been granted a licence by:
- referring hosts to the Register of Licensed Labour Hire Providers
- publishing a link to the Register of Licensed Labour Hire Providers on their website
- providing their licence number
- showing hosts their licence.
Labour hire licence applicants can show they may provide labour hire services by:
- referring hosts to the Received Labour Hire Application Register
- publishing a link to the Received Labour Hire Application Register on their website and noting the date their application was received by the Authority.
